McConnell Air Force Base, Kansas–Mr. Tolin came into this case as the third defense counsel for this client. This 17-year NCO had failed multiple PT tests in a row, and the only negative paperwork she had was for those failures. Her command administratively took away her E-6 stripe to teach her a lesson. She kept asking for medical care, but the militray medical providers kept telling her she just needed to diet and excercise.
When she couldn’t get a specialist scheduled through the military, she went out of pocket to schedule an appointment with an specialist. We presented testimony at the discharge board from that endocronology expert that she actually had polycystic ovary syndrome (PCOS) and had started treatment of her. She just needed some time.
The government argued she had more than enough chances and should’ve been out of the Air Force months prior. After all, its providers at the medical group disagreed with the specialist.
Mr. Tolin secured a recommendation for probation & rehabilitation, and with treatment, her medical issues resolved, and her PT score skyrocketed back to 97, where it had always been before needing medical care. She returned to her unit head held high to serve until retirement.
